AG Madigan releases immigration guide

SPRINGFIELD – Illinois Attorney General Lisa Madigan’s office is issuing a new guide to help law enforcement with new immigration laws.

Madigan said with changes in laws like the Trust Act recently signed in Illinois, there has been some confusion about what the police can and cannot do.

“Under the Trust Act as well as the Fourth Amendment, people can’t be stopped, they can’t be arrested solely on the basis that an individual may be undocumented,” Madigan said. “That arrest can only be made by law enforcement when they have an arrest warrant or when they’ve got probable cause to believe that a criminal offense has been committed.”

The AG’s office also has a guide for immigrants, called “Know Your Rights.”

Both the guide for law enforcement and a separate pocket guide for immigrants can be found on Madigan’s website.
