BLOOMINGTON – A Bloomington man is charged with two counts of reckless homicide for a single-car crash early Thursday west of the Twin-Cities.
McLean County State’s Attorney Jason Chambers revealed in court the blood alcohol level for Brenton Fenwick was at .043, which is below the legal limit of intoxication. However, Chambers said the blood and urine samples were taken about two hours after the crash that killed a passenger in Fenwick’s car, Dylan Baerwald, 25, of Bloomington.
Chambers said more complete lab tests are being done to determine if Fenwick, 24, should face a more serious charge of DUI.
The felony reckless homicide charges allege Fenwick was driving at a speed that was “greater than reasonable or proper,” and hit an incline at the intersection of County Road 1000 East and Illinois Route 9. The vehicle reportedly became airborne and struck a tree.
A judge set bond on the felony charges at $500,000, meaning Fenwick would have to post 10 percent of that or $50,000 to be released while awaiting trial.
