Durbin demands hearing for Supreme Court nominee

WASHIGNTON – U.S. Sen. Dick Durbin (D-Ill.) is demanding a fair hearing in the Senate for President Obama’s choice for the Supreme Court.

Durbin said the Constitution doesn’t leave any gray area on the issue.

“What does the Constitution say about a vacancy on the Supreme Court. If you’ll go to Article 2, Section 2, it is explicit and very simple,” said Durbin. “The president, quote, ‘shall nominate and by and with the advise and consent of the Senate, shall appoint judges of the Supreme Court.'”

Durbin said the Senate can’t afford to sit on its hands for a year and leave the Supreme Court hanging in the balance. Durbin noted major legal and constitutional questions are constantly brought before the court.
